The rules that govern your use of the Rank Up Martial Arts website, the $60 two-week trial offer, and class enrollment.

1. Acceptance of Terms
By using the Rank Up Martial Arts website, signing up for a trial, or enrolling in classes, you agree to these Terms and Conditions ("Terms"). If you do not agree, do not use the website or our services. References to "we," "us," or "our" mean Rank Up Martial Arts, located at 410 W Capitol Expressway, Suite 20, San Jose, CA 95136.
These Terms apply to every visitor, prospective student, parent, guardian, and enrolled student.
2. Use of the Website
You may use this website for personal, non-commercial purposes only. You agree not to:
- Use the website in any way that violates federal, state, local, or international law.
- Attempt to gain unauthorized access to the website, its servers, or any connected systems.
- Interfere with or disrupt the website, introduce malware, scrape content at scale, or use automated tools without permission.
- Impersonate Rank Up Martial Arts or any of its instructors, staff, or students.
- Copy, reproduce, or redistribute website content without our written permission, except for personal reference.
3. Intellectual Property
All content on the website, including text, graphics, logos, photographs, videos, design elements, and source code, is owned by Rank Up Martial Arts or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.
"Rank Up Martial Arts" and the Rank Up logo are marks of our studio. You may not use them without our written permission. Reproduction of any website content for commercial purposes is prohibited.
4. The $60 Two-Week Trial Offer
Our two-week trial is a promotional offer subject to the following terms:
- New students only. The trial is available to students who have not previously enrolled at Rank Up Martial Arts.
- One trial per student. Each individual student may claim the trial offer once.
- Price. The trial is $60, charged at registration through our enrollment provider.
- Included. A free uniform (yours to keep regardless of whether you continue), free registration, and unlimited classes at your belt level for two consecutive weeks beginning on your first class.
- Age. Open to students ages four and up. Class placement is matched to age and belt level.
- Duration. Two consecutive weeks. Missed classes during the trial do not extend the trial period.
- No automatic enrollment. The trial does not automatically convert to ongoing tuition. If you choose to continue, we will discuss tuition options with you separately.
- Refunds. The trial fee is non-refundable once classes begin. If you change your mind before your first class, contact us and we will refund the trial fee in full.
We reserve the right to modify, suspend, or discontinue the trial offer at any time. Active trial registrations are honored at the terms in effect at registration.
5. Class Enrollment, Waivers, and Code of Conduct
5.1 Enrollment
Ongoing class enrollment requires a separate enrollment agreement that addresses tuition, schedule, payment terms, and cancellation. The enrollment agreement controls in the event of any conflict with these Terms.
5.2 Required waivers
Every student (or the parent or legal guardian of a minor student) must sign a participation waiver before stepping on the mat. The waiver covers assumption of risk, release of liability, and emergency medical authorization. Students cannot participate until the waiver is on file.
5.3 Code of conduct
The five tenets of Taekwondo are Courtesy, Integrity, Perseverance, Self-Control, and Indomitable Spirit. Every student and family is expected to uphold them inside and outside the studio. We reserve the right, in our sole discretion, to remove any student whose behavior, or whose family member's behavior, is unsafe, disrespectful, or contrary to the standards of the studio. No refund of unused tuition is owed in cases of removal for conduct.
5.4 Studio rules
Studio rules are posted at the studio and communicated to every student during their first class. Highlights include: arrive five minutes early to stretch, do not disturb a class in session, bring a water bottle, do not climb on equipment, keep your uniform clean, and students may not leave the studio without a parent or guardian.
6. Assumption of Risk
Taekwondo and other martial arts are physical activities. They involve striking, kicking, controlled contact, falling, and intense conditioning. Even with proper instruction, supervision, and equipment, injuries can and do occur, ranging from minor (bruises, sprains) to serious.
By enrolling, participating, or allowing a minor to participate, you knowingly and voluntarily assume the inherent risks of martial-arts training. You confirm that you and (where applicable) your child are in good health and able to participate in vigorous physical activity, or that you have consulted a physician before participating.
This assumption of risk is in addition to, and not a substitute for, the participation waiver signed at enrollment.
7. Photo, Video, and Media Release
Photographs and video of classes, demonstrations, belt promotions, and studio events may be taken by Rank Up Martial Arts staff or authorized photographers. These may appear on our website, social media, printed materials, and other promotional channels.
For minor students, a separate written photo and media release is requested at enrollment. We will not publish identifiable images of a minor without that release on file. Adult students provide their own consent at enrollment.
You may withdraw consent at any time by contacting rankupma@gmail.com. We will remove identifiable images from materials we control. Images already published on third-party platforms or in printed materials may take longer to remove.
8. Payments, Refunds, and Cancellation
- Trial fee. See Section 4. Non-refundable once classes begin; fully refundable if cancelled before the first class.
- Ongoing tuition. Tuition terms are set in your enrollment agreement. We do not refund tuition for missed classes (you may make them up by attending an alternate class at your belt level).
- Belt testing fees, uniforms beyond the trial, sparring gear, and special events are not included in trial or tuition pricing and are billed separately.
- Payment processing. Trial registration and ongoing payments are handled by our enrollment provider, Jibasoft. By registering, you agree to Jibasoft's terms in addition to ours.
9. Third-Party Services
Our website and operations rely on the following third-party providers. Each has its own terms and privacy policy that apply when you use those services:
- Jibasoft for trial signup, enrollment, scheduling, and payment processing.
- FormSubmit for processing contact-form submissions.
- Google Maps for the embedded studio maps on our Contact and Home pages.
- Google Analytics and Google Tag Manager for understanding how the website is used (only with your consent through our cookie banner).
- Google Fonts for the typefaces used across the site.
- Hosting.com for website hosting.
We are not responsible for the practices or content of third-party services.
10. External Links
Our website may contain links to third-party websites for your convenience. We do not endorse and are not responsible for the content, products, services, or practices of those third-party websites. Visiting a linked site is at your own risk and subject to that site's terms.
11. Disclaimer of Warranties
The website and all content are provided "as is" and "as available," without warranty of any kind, express or implied. We do not warrant that the website will be uninterrupted, error-free, secure, or free of viruses. We do not warrant the accuracy, completeness, or reliability of any information on the website. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of Liability
To the fullest extent permitted by law, Rank Up Martial Arts, its owners, instructors, employees, contractors, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the website, the trial offer, or our services. Our total liability for any claim arising out of or related to the website or these Terms shall not exceed the amount you paid us in the twelve months preceding the claim.
Nothing in this section limits liability that cannot be limited under California law, including liability for gross negligence, willful misconduct, or personal injury caused by our negligence to the extent that such limitation is not permitted by law.
13. Indemnification
You agree to defend, indemnify, and hold harmless Rank Up Martial Arts and its instructors, employees, contractors, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your violation of these Terms, (b) your misuse of the website, or (c) your violation of any rights of a third party.
14. Governing Law and Disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms, the website, or our services shall be resolved in the state or federal courts located in Santa Clara County, California, and you consent to the jurisdiction of those courts.
Before filing a claim, you agree to first attempt to resolve the dispute informally by contacting us at rankupma@gmail.com. We will work in good faith to resolve any reasonable issue.
15. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be severed and the remaining provisions shall remain in full force and effect.
16. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Effective Date" at the top of this page. Material changes will be communicated through the website. Your continued use of the website or our services after a change indicates your acceptance of the updated Terms.

Note. These Terms are provided as starter copy for the Rank Up Martial Arts website. They reflect standard best practices for a California-based martial arts studio, including assumption-of-risk language and a media release section. Martial arts liability waivers, in particular, vary by state and are often the subject of separate signed agreements at enrollment. We strongly recommend having these Terms and your enrollment waiver reviewed by an attorney familiar with California law and the martial arts industry before publishing or relying on them.
